<p><persName ref="prs:kennedy_a">Kennedy</persName> forwards correspondence regarding a fine imposed on the <name ref="vsl:alexandra" type="vessel">Alexandra</name> while trading at <placeName ref="plc:port_angeles">Port Angeles</placeName>. <persName ref="prs:kennedy_a">Kennedy</persName> suspects that the fine is unlawful and imposed by the owner of <q>a rival American Steamer.</q> The <orgName ref="org:colonial_office">Colonial Office</orgName> minutes their decision to hand the matter over to the <orgName ref="org:foreign_office">Foreign Office.</orgName></p>

<p>
I have the honor to transmit papers relative to fines imposed upon a
British Steamer, the "<name ref="vsl:alexandra" type="vessel">Alexandra</name>" in the course of her trading to <placeName ref="plc:port_angeles">Port
Angelos</placeName> in the <placeName ref="plc:washington_territory">Washington Territory</placeName>, United States.
</p>
<p>
I lean to the belief that these fines have been improperly imposed,
and I have reason to<fw type="catchword" style="text-align: right;">believe</fw><pb facs="co_305_23/co_305_23_00270v.jpg"/> believe that the Collector at <placeName ref="plc:port_angeles">Port Angelos</placeName>
(United States) holds the same opinion.
</p>
<p>
It would appear that the law has been put in motion by the owner of
the "<name ref="vsl:eliza_anderson" type="vessel">Eliza Anderson</name>" a rival American Steamer on the same line to
enable her to monopolize the trade.
</p>
<p>
I feel sure that the matter only needs to be brought under the notice
of the proper authorities at <placeName ref="plc:washington_city">Washington</placeName> to rectify any<fw type="catchword" style="text-align: right;">misunderstanding</fw><pb facs="co_305_23/co_305_23_00271r.jpg"/>
misunderstanding which exists, and I would feel obliged if this were
done without unnecessary delay.

The fines seem to have been inflicted under "An act to amend an act
entitled 'An act to provide for the better security of the lives of
passengers on board of vessels propelled in whole or in part by
steam'" <date when="1852-08-30">Aug. 30. 1852</date> ch. 106. U.S. statutes at Large Vol X. p. 61.
</ab>
<p>
The 42<hi style="vertical-align: super; font-size: 80%;">nd</hi> section (p. 75) enacts that
"<hi style="text-decoration: underline;">this act shall not apply to</hi> public vessels of the United
States or
<hi style="text-decoration: underline;">vessels of other countries.</hi>" and the 44<hi style="vertical-align: super; font-size: 80%;">th</hi> section repeals "all
parts of Laws heretofore made which are suspended by or are
inconsistent with this act."
</p>
<p>
Probably therefore the U.S. authorities would at once disallow the
act of the Collector of Customs at <placeName ref="plc:port_angeles">Port Angelos</placeName>, who, according to
<persName ref="prs:kennedy_a">Gov. Kennedy</persName>'s account, seems to have imposed the fines (for some
reason unexplained) in spite of his own opinion that it was improper
to do so.
