<p><persName ref="prs:richards_gh">Richards</persName> acknowledges receipt of correspondence regarding the ownership of <placeName ref="plc:fisgard_island">Fisgard
Island</placeName>. He reports that the island belongs to <persName ref="prs:young_c">Cecilia Young</persName>. While <persName ref="prs:richards_gh">Richards</persName> observes that the
island <q>is very small and of no intrinsic value,</q> he does not believe it is <q>unfair</q> for <persName ref="prs:young_c">Young</persName> to expect <q>some remuneration</q>
for its use as a lighthouse location. Because the matter also involves <persName ref="prs:young_c">Young</persName>’s husband,
<persName ref="prs:young_wag">Colonel Secretary W. A. G. Young</persName>, <persName ref="prs:elliot_tf">Elliot</persName> minutes his suspicion that <persName ref="prs:kennedy_a">Kennedy</persName> may
be <q>unnecessarily apprehensive about this case.</q></p>

I have the honor to acknowledge the receipt of your letter of <date when="1864-08-20">19<hi style="vertical-align: super; font-size: 80%;">th</hi>
instant</date> enclosing copies of dispatches from the Governor of <placeName ref="plc:vancouver_island">Vancouver
Island</placeName> on the subject of the ownership of <placeName ref="plc:fisgard_island">Fisgard Island</placeName>, and
requesting that I will communicate to you for <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cardwell</persName>'s use any
information I may be able to supply relative to the ownership of this
Rock in the first instance by a Private Individual.
</p>
<p>
Previous to the transfer of the Colony of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> from the
<orgName ref="org:hbc">Hudson's Bay Company</orgName> to Her Majesty's Government, the whole or nearly
the whole of the Shores of <placeName ref="plc:esquimalt_harbour">Esquimalt Harbour</placeName> together with the
numerous small Islands in it were owned either by the <placeName ref="plc:puget_sound">Puget Sound</placeName>
Company or by private individuals.
</p>
<p>
The property of Belmont at the Entrance of the harbour was I believe
owned by <persName ref="prs:young_c">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Young</persName> before her marriage, or by her father, and
<placeName ref="plc:fisgard_island">Fisgard Island</placeName>, a bare Islet between<fw type="catchword" style="text-align: right;">100</fw><pb facs="co_305_24/co_305_24_00013v.jpg"/> 100 and 200 yards in extent and
20 feet high, lying about 100 yards from Belmont, was I believe an
adjunct of that property.
</p>
<p>
When the Colony was established under Government auspices and became
the head quarters of the Navy with a prospect of Government
Establishments Light Houses &amp;c, the price of land in <placeName ref="plc:esquimalt_harbour">Esquimalt
Harbour</placeName> rose very considerably.
</p>
<p>
Although <placeName ref="plc:fisgard_island">Fisgard Island</placeName> is very small and of no intrinsic value, yet
I think it must be considered in the same category as various other
apparently equally valueless spots of ground in <placeName ref="plc:esquimalt">Esquimalt</placeName>, and when
it was chosen as the site of a Light House. I do not think it was
unfair that the Proprietor of it should have expected some
remuneration, nor do I conceive, looking to parallel cases, that the
remuneration paid to <persName ref="prs:young_c">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Young</persName> was unreasonable.
</p>
<p>
As regards the money having been paid before a deed of Transfer was
made; there was not the greatest regularity observed in such matters
owing to the want of Legal Officers &amp;c, but I apprehend that the
omission lay with the Surveyor General,<pb facs="co_305_24/co_305_24_00014r.jpg"/> and not with <persName ref="prs:young_c">M<hi style="vertical-align: super; font-size: 80%;">rs</hi> Young</persName>.
</p>
<p>
I beg to enclose a Chart of <placeName ref="plc:esquimalt_harbour">Esquimalt Harbour</placeName> by which <persName ref="prs:cardwell">M<hi style="vertical-align: super; font-size: 80%;">r</hi> Cardwell</persName>
will better understand the bearings of the case, and I shall be very
happy to give any further information personally if required.

I think the <choice><abbr>Gov<hi style="vertical-align: super; font-size: 80%;">r</hi></abbr><expan>Governor</expan></choice> <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be ans<hi style="vertical-align: super; font-size: 80%;">d</hi> by sending him a copy of this report
of the Hydrographer of the Adm<hi style="vertical-align: super; font-size: 80%;">y</hi>, &amp; that he <choice><abbr>sh<hi style="vertical-align: super; font-size: 80%;">d</hi></abbr><expan>should</expan></choice> be instructed to
follow the advice of the Attorney <choice><abbr>Gen<hi style="vertical-align: super; font-size: 80%;">l</hi></abbr><expan>General</expan></choice> of <placeName ref="plc:vancouver_island">V.C.I.</placeName> as to the proper
mode of completing the conveyance to the Crown of <placeName ref="plc:fisgard_island">Fisgard Island</placeName>, as
the Surveyor <choice><abbr>Gen<hi style="vertical-align: super; font-size: 80%;">l</hi></abbr><expan>General</expan></choice> has neglected to sign the Deed.
</p>
