<p><persName ref="prs:head_ew">Head</persName> sends detailed legal documents filed in the Supreme Court of Civil Justice relating to proceedings commenced against the <orgName ref="org:hbc">Hudson's Bay Company</orgName>. He comments that in his opinion the legal proceedings were <q>at variance</q> with a prior agreement that stipulated all <orgName ref="org:hbc">HBC</orgName> land sales prior to <date when="1862-01-13">13 January 1862</date> would be <q>held valid.</q> The <orgName ref="org:colonial_office">Colonial Office</orgName> sends the documents to the Land Board.</p>

<p>
I have the honour to enclose for the information of the Secretary of
State a copy of a document transmitted from <placeName ref="plc:vancouver_island">Vancouver's Island</placeName>, being
an information &amp; interrogatives filed against the <orgName ref="org:hbc">Hudson's Bay Company</orgName>
in Chancery by the Attorney General of the Colony.
</p>
<p>
It appears to me<pb facs="co_305_24/co_305_24_00209v.jpg"/> that these proceedings are entirely at variance with
the purport of the agreement entered into on <date when="1862-02-03">February 3<hi style="vertical-align: super; font-size: 80%;">d</hi> 1862</date> by
which it was stipulated that the sales made by the Company previous
to <date when="1862-01-13">January 13 1862</date> were to be held valid &amp; effectual as against the
Crown.
</p>
<p>
It is true that the alleged relator is not the Crown but <persName ref="prs:pemberton_jd">M<hi style="vertical-align: super; font-size: 80%;">r</hi> John
Despard Pemberton</persName> the Surveyor General of the Colony, but of the
character &amp; object of the proceedings there can be no doubt. We
trust that the Right Honble. The Secretary of State will give
instructions to stop<pb facs="co_305_24/co_305_24_00210r.jpg"/> all proceedings on the part of the Crown
Officers contrary to the tenor of the Indenture of <date when="1862-02">February 1862</date>,
which we on the part of the Company are prepared at once to carry out
by the best means which can be derived. For this purpose <persName ref="prs:dallas">Mr Dallas</persName> &amp;
myself last week had an interview with <persName ref="prs:murdoch_twc">Mr Murdoch</persName> &amp; the course to be
pursued was in the main agreed upon.
