<p><persName ref="prs:cardwell">Cardwell</persName> conveys his disapproval of several clauses in <q>An Act to authorized the <orgName ref="org:harewood_railway">Harewood Railway Company</orgName> (Limited) to make a Railway from <placeName ref="plc:departure_bay">Departure Bay</placeName>, <placeName ref="plc:nanaimo_district">Nanaimo District</placeName>, to the Harewood
 Coal fields in <placeName ref="plc:mountain_district">Mountain District</placeName> <placeName ref="plc:vancouver_island">Vancouver Island</placeName>.</q> <persName ref="prs:cardwell">Cardwell</persName> notes that these clauses <q>impose certain conditions on the Company without imposing any penalty.</q></p>

Among the Acts passed by the Legislature of <placeName ref="plc:vancouver_island">Vancouver Island</placeName> in
<date when="1864">1864</date>, which accompanied your Despatch No. 93 of the <date when="1864-11-22">22nd of November</date> I
have received Cap: XVIII entitled
<milestone unit="section" rend=".ind on"/> "An Act to authorized the <orgName ref="org:harewood_railway">Harewood Railway Company</orgName> (Limited) to
make a Railway from <placeName ref="plc:departure_bay">Departure Bay</placeName>, <placeName ref="plc:nanaimo_district">Nanaimo District</placeName>, to the<fw type="catchword" style="text-align: right;">"Harewood</fw><pb facs="rg7_g8c_05/rg7_g8c_05_00056v.jpg"/> Harewood

I take it for granted that the first Clause of this Act is not
intended to give to the Company any compulsory powers, but only that it
shall have the legal capacity to hold such lands as are required for
it's purpose: on this assumption the clause is unobjectionable; the 2nd
and 3rd clauses however are very imperfect as they impose certain
conditions on the Company without imposing any penalty or inconvenience
upon them in case they should neglect these conditions.

Although I have advised Her Majesty to leave this Act to it's
operation, yet I do not consider that it has been prepared in the Colony
with sufficient care. It is very necessary that the proper Officer of
the Government should exercise so much control over enactment of this
kind as to prevent their being passed in a manifestly defective shape.
