No. 80
13 November 1867
Sir,
I have the honor to acknowledge the receipt of your despatch No. 112 of the 16th September enclosing the British Columbia Ordinance No. 32 of April 1867 "An Ordinance to give to Mortgagees certain powers now commonly inserted in Mortgages."
IManuscript image
I am of opinion that it would have been better if the 3rd Section had provided that six months notice of sale should be given instead of three months, and I think it would be desirable that a Clause should be inserted to the effect that a mortgagee who purchases property under the conditions imposed by the 5th, 6th and 7th Sections, should be deprived of any further remedy under the covenant for the balance of the Mortgage Money.
Under these circumstancesIManuscript image I shall be prepared to submit the Ordinance for Her Majesty's confirmation on your amending it by the insertion of a Clause to the above effect.
I have the honor to be
Sir,
Your most obedient
humble Servant
