I have the honor to acknowledge the receipt of your Despatch No 11 dated 27th February 1865 on the subject of a pier which Colonel Foster has thrown out from his property in Esquimalt Harbour in this Colony, and in reply I have the honor to enclose the letters named in the margin

Denman to Kennedy, 9 June 1865, advising that as the encroachment appeared to have been a mistake, and the resulting inconvenience small, it should be allowed to stand under certain conditions relating to availability and state of repair.
