No. 35
14th June 1864

It would have been more satisfactory to me if this case had been finally closed by my Predecessor and it is I think very inexpedient that it should be longer left open.
You will observe that I brought the matter under the notice of my Executive Council who decided uponforegoingManuscript image foregoing any further proceedings for the recovery of the amount of Gordon's defalcations from his sureties.
On a full consideration of all the information I have been able to obtain, I concur in this decision, and have therefore directed the amount to be written off the public accounts as irrecoverable.
I have the honor to be
Sir
Your very obedient Servant

The enclosures are now annexed. The defalcation amountsManuscript image to £1121.5.3. In the opinion of the Attorney General the sum cannot be recovered from the Sureties; there appears therefore to be no other course open than to submit to the loss, as resolved by the Council. The Govr has recently appointed Mr Ker to act as Auditor.
