My Lord,
I have the honor to forward an authenticated and two plain copies of a bill passed by the Legislative Council, during the late Session, but not yetassentedManuscript image assented to by me. It is entitled; An Ordinance to extend certain provisions of the 18 and 19 Vict: cap 90 to the Colony of British Columbia.
2. I enclose the report of the Attorney General.
3. I cannot see the necessity for the measure and in another ColonywithManuscript image with which I was connected a similar law was found far from satisfactory.

Bill relating to Crown Costs.
I think that the Governor should be instructed not to assent to this Bill.
By its title it professes to extend certain provisions of 18 & 19 Vict C. 90 to B. Columbia.
But in the first place I am disposed to think that under the B.C. Ordinance of 1867 the provisions of this Imperial Act are in force in the Colony.
And secondly this Bill goes far beyond the Imperial Act, which is confined to suits & proceedings "in respect of land tenements &c or of any goods or chattels belonging to the Crown, or of sums of money voted to HM for the service of the Crown."
But this Bill would in terms include all prosecutions, & proceedings by the Crown of whatever Kind.
It might be intimated to the Govr that should doubts be entertained as to the applicability of the Imperial Act to the Colony, such doubts might fairly be removed.

I do not think it wd be worth while interfering. The Act seems reasonable in itself: andManuscript image if the Legre likes it I wd let them have it.
It is as well to reserve our resistance in case of representative or quasi-representative Govts for cases of injustice or gross mischief or Imperial interest.
