I have the honor to acknowledge the receipt of your Despatch No.
107 of the
26th August reporting that the Draft Ordinance which had been
prepared in this Country for the constitution of a Supreme Court of
British Columbia in such a manner as to set at rest the anomalies
arising out
of of the Union of
British Columbia and
Vancouvers Island had
been rejected, and that you had allowed another Ordinance to be passed
in substitution for it.
A Copy of that Ordinance entitled An Ordinance "to establish a
Supreme Court of Justice in the Colony of
British Columbia," you enclose
in your despatch. I have perused this Ordinance, but it is impossible
for me to submit it for Her Majesty's approval inasmuch as it
contemplates a Supreme Court composed of a Chief Justice and Puisne
Judge and is therefore inapplicable to the existing
state state of things in
British Columbia in which unfortunately there exist two Chief Justices.
