Sir,
I have the honor to inform you that Mr Walter Moberley having resigned his seat as Member of the Legislative Council for Cariboo West, I instructed the Magistrate of the District to call upon the InhabitantstoManuscript image to select a Representative to fill the vacancy thus created.
2. Three candidates appeared to contest the election. Doctor Black, who represented the district in the first Council, Mr Evans, put forward by the Merchants of Victoria to advocate Union of the Colonies, and Mr R. Smith, formerly a miner and now a Road Contractor. The latter Gentleman was selected by a large majority.

3. I have therefore appointed Mr Robert Smith to be a member of the Legislative Council, subject to your pleasure until the 1st of June 1866.

The 5th Clause of the Order in Council of 11 June 1863 requires that the appointment of Legislative Councillors should be approved by the Queen thro the S. of S.
