The Ordinance of 1867 has been repealed (though it is wrongly cited in this Ordinance) & this Ordinance adopts the amendments suggested by this Department. A new section—sect. 5—is added, which as it is confined to Estates under $500 dollars may perhaps be allowed upon the strong recommendation of the Attorney General. But I should be disposed to state that HG only allows the section in accorde with such strong recommendation, and that he wd not be prepared to sanction so novel a clause in cases of Estates of any larger value than that fixed by the Ordinance.
