I have the honor to acknowledge the receipt of your Despatch No.
111 of the 12th August, and to convey to you Her Majesty's Gracious
Confirmation and allowance of Ordinance No. 13 of 1870 passed by the
Legislative Council of BritishColumbiaColumbia and entitled "An Ordinance to amend the
Road Ordinance 1869."
With reference to the 9th clause I have to observe that though it
is quite just that the Government should have power to take Gravel,
stone, timber &c if required for Public Works, it appears unfair that
compensation should not be given for whatever is thus taken equivalent
to the loss really imposed on the land owner.
I have the honor to be
Sir,
Your most Obedient humble Servant Kimberley
