No. 47
1st July 1865
Sir,
I have the honor to enclose a letter from Mr Henry Wakeford which explains itself, in reference to your Despatches named in the margin.
No 4, 24th January 1865.
No 10, 25th February 1865.
The Legislative Assembly having made provision for a Private Secretary at the rate of £350 per annum I have, subject to yourapprovalManuscript image approval, offered, and Mr Wakeford has accepted that office.
The Assembly have also voted the sum of $1200 for the salary of an Auditor for 1865, and it being wholly impossible to procure the services of a competent or reliable officer for that sum I have appointed Mr Wakeford to perform the duties of that office in addition to those of Private Secretary drawing salary at the rate of $1200 per annum from date of appointment.
There is nothing incompatible that I am aware of in these jointofficesManuscript image offices, and the joint salary is the minimum upon which a public officer can maintain a family in this Colony where the cost of living is so very high.
Mr Wakeford has discharged the duties of Colonial Secretary during Mr Young's absence with great industry and ability and has rendered me important assistance in the Government of the Colony.
I have the honor to be,
Sir,
Your most obedient Servant
A.E. Kennedy
Governor

It will make things more comfortable for Governor Kennedy if he be allowed to have Mr Wakeford as his Private Secretary. A good Auditor will also be advantageous for the public interests. I am aware of no local Act granting the Salaries of these situations permanently. I suppose they are provided for in the Appropriation Act for this year, which has not reached us. Mr Wakeford has probably well considered the prudence of relinquishing a fixed office in Australia for places the Emoluments of which are dependent on the pleasure of such a Ho: of C. as there is in V.C. Island.
I pass this to Mr Cox with reference to the Australian Magistrary now vacant.

Mr Elliot
Inform GovernorManuscript image Hampton of Mr Wakefords resignation of his appointment of Police Magistrate at Perth with reference to Mr Cardwells dispatch No 23 of the 25th of Feby last. The Salary of the appointment is £360 per annum & I presume that the Governor will be allowed to select Mr Wakefords successor. It will be necessary to inform the Agents with reference to the letter respecting the continuance of the payment of Mr Wakefords half salary whichManuscript image was addressed to them on the 1st of June last. By that letter they were authorized to Continue the issue of the half salary to the 14th of June last. Mr Wakefords resignation (I am assuming that he is confirmed in his new appointment) is dated the 26th of June so that they will have to be authorized to pay Mr Wakefords half salary on account of his office of Police Magistrate for the additional twelve days.

Mr Cardwell
So far as regards Mr Wakeford the course appears to me plain. I should confirm his appointment to the offices both of Private Secretary & of Auditor and should inform Governor Hampton that this has been done, and that the appointment of Police Magistrate at Perth in consequence becomes vacant.
A second question is the filling up of that Office in Western Australia. The salary is £360. When Mr Wakeford went on leave, Governor Hampton reported that with a view to establishing on a sound legal footing the business of the Small Debt Court, he had appointed Mr Leake the Crown Solicitor to be acting Police Magistrate. I infer from this that legal attainments are desirable. It will be for you to determine whether to leave the appointment to the Governor or send out some one from home.

I should like Mr Parker to see to the question as regards W.A. I believe he has Papers about it.
